The liability of Courtesy Computers, Inc. to the Customer for damage to or loss of data shall be limited to the undertaking of a re-backup of the lost or damaged data from the Customer's computer. Under no circumstances will Courtesy Computers, Inc. be liable for the contents or value of the Customer's lost or damaged data. Furthermore, Courtesy Computers, Inc. will not be liable for incidental or consequential damages even if it is advised of the possibility thereof. This limitation of Courtesy Computers, Inc. liability will apply regardless of the form of action, whether in contract or tort (including negligence).

Customer warrants that it is the owner or legal custodian of the data transmitted to Courtesy Computers, Inc. and that it has full authority to transmit said data and direct its restored data at its designated computer.
